Terms and Conditions

1. Scope These Terms and Conditions ("T&Cs") apply to all activities carried out by MolardWeb SA (hereinafter the "Company", UID: CHE-200.412.088, located at Chemin de l’Emeraude, 1214 Vernier).

The Company sells high-quality sports and fitness products on its website. These T&Cs apply to all sales made by the Company, whether through the website, resellers, telephone, email, verbal agreement, or any other expression of intent.

By accessing and using the Company’s website, particularly by purchasing its products, the customer acknowledges being bound by these T&Cs and declares having read and understood them.

The Company reserves the right to modify these T&Cs at any time and at its sole discretion. It is the customer’s responsibility to review them regularly to stay informed of any changes. The version in effect at the time of contract conclusion shall apply, unless the customer has expressly agreed in writing to different provisions.

2. Contract Conclusion The contract is concluded when the customer accepts the Company’s offer related to the purchase of its products. The contract is considered concluded as soon as the customer accepts the services and/or places an order on the website or purchases directly.

3. Prices Unless otherwise agreed, all prices are listed in Swiss Francs (CHF). The Company may display prices in other currencies depending on the country. Prices include VAT where applicable. The applicable VAT rate is determined by the customer’s country. Prices do not include additional applicable taxes, nor shipping and packaging fees. The Company may change its prices at any time. Prices at the time of contract conclusion apply.

4. Payment Payment methods offered: Invoice, Credit Card, PayPal, ApplePay, Bitcoin, Twint, and Postcard.

Invoices must be paid within 30 days of issuance. In case of late payment, the customer is automatically in default. Billing is handled by swissbilling SA. More information: www.swissbilling.ch/swb-CGV/

The Company may require advance payment and refuses any offsetting by the customer. In case of late payment, the Company may withhold delivery or service.

5. Company Obligations 5.1. Delivery Delivery within 2 business days for Swiss orders. International orders may take longer. If timely delivery is not possible, the customer will be notified within 5 business days and offered an alternative. In cases of force majeure (natural disaster, war, strikes, etc.), the Company is released from its obligation to perform. If such events last more than 30 days, the Company may withdraw from the contract and fully refund the customer. All further claims for damages are excluded. Unless otherwise agreed, place of performance is the Company’s registered office. Delivery is considered fulfilled once the goods are handed to the transporter.

5.2. Subcontractors The Company expressly reserves the right to use third parties to fulfill its contractual obligations.

6. Exchange Products may be exchanged within 7 days of receipt, provided they are unused and in their original packaging. Return and exchange shipping costs are the customer's responsibility.

7. Warranty Legal warranty provisions apply. Warranty duration: 24 months. Defects must be reported immediately. The Company will decide whether to repair or replace the defective item. Price reduction or refund is only possible if repair or replacement is not feasible. No right to a replacement product during the repair period. The repaired part’s warranty resets, the rest continues under the original term.

8. Liability No liability for indirect or consequential damages. Liability for direct damage is limited to the purchase price. No liability for auxiliary persons, as far as permitted by law.

9. Intellectual Property The Company holds all rights to its products and services. These T&Cs do not transfer any intellectual property rights unless explicitly stated. Any reuse, publication, or dissemination of information, images, texts, or content is prohibited without the Company’s written consent. The customer must ensure they do not violate third-party intellectual property rights.

10. Data Protection The Company processes personal data to fulfill contractual obligations and complies with data protection laws. Data may be shared with service partners and authorities when legally required. The customer agrees to data use for marketing unless explicitly declined. The applicable data protection legislation applies.

11. Entire Agreement These T&Cs supersede all prior agreements. Individual contracts take precedence over these T&Cs where applicable.

12. Severability Clause If a clause is found to be invalid, it will be replaced by a valid one that closely matches the original intent. The same applies in case of contractual gaps.

13. Confidentiality The customer, Company, and third parties involved agree to confidentiality of all exchanged information, even after contract termination.

14. Governing Law / Jurisdiction Swiss law applies. Jurisdiction lies at the Company’s registered office, unless otherwise required by mandatory legal provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods is excluded.
